DEFINITIONS
The “Seller” is defined as the legal entity Delicieux Cakes. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in this invoice.

GENERAL
These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Delicieux Cakes, you agree to be legally bound by these Terms and Conditions, and accept that these Conditions may be modified or amended and posted on this website from time to time.

PAYMENT AND DEPOSIT – CAKE ORDERS
We require a 50% non-refundable Booking Fee to confirm a celebration cake order, the remaining amount is due on the day of delivery.

For Wedding Cakes we require a £100.00 non refundable deposit to confirm your order and secure the date. The remaining 50% is due 4 weeks before the delivery date, at which point all changes must be confirmed (changes to the previously agreed design may incur extra fees). Wedding Cake Orders placed less than 4 weeks in advance of the delivery date must be paid in full. The final balance specified on the invoice must be paid by the Buyer 4 weeks before the delivery date. Payment can be made earlier if you wish. Failure to complete payment 4 weeks before the delivery date may result in your order being cancelled. By making a payment the Buyer is accepting the Terms and Conditions as detailed on this page.

REFUNDS AND CANCELLATIONS – CAKE ORDERS
In the event of a cancellation by yourselves, charges are as follows:

• More than ninety days prior to the date = booking fee only;
• Ninety days to one calendar month prior to the date = booking fee plus half the remaining cost;
• Less than one calendar month prior to the date = full amount;
• Any booking fees previously paid are non-refundable.

In the event of a wedding postponement, the payment due remains the same as a cancellation. If you postpone within 90 days of the wedding half the remaining cost will be due on the original payment date. If you postpone less than one month prior to the wedding, the outstanding balance remains payable on the original due date. Subject to availability we will carry any monies paid forward to the new wedding date. Please be aware that we will only do this on one occasion. Any further postponements will be classed as a cancelation. Postponements may also be subject to an increase in costs, in line with the annual cost of inflation, depending on the duration of the postponement.

You may, prior to 8 weeks before the wedding day, or 10 days for celebration cakes, amend your order by providing us with written notice. In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after the time scale stipulated above there will be no reduction in the price you pay, even if your new design is cheaper than the original booking.

If for any reason you fail to collect your cake order, we reserve the right to take action to recover any balances outstanding.

Delicieux Cakes reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Delicieux Cakes, and Delicieux Cakes shall not be liable for any breach of contract resulting from such an event. In this situation we will provide you with written notice and any booking fees paid are non-refundable and we refer to our cancellation policy. As such we advise you to purchase wedding insurance.

CONSULTATIONS
Consultations are by appointment only and are not applicable to all orders. An appointment for a consultation and tasting must be agreed on with Delicieux Cakes, by email and a non-refundable Consultation Fee that must be paid at least one full week before the agreed Consultation Date.

PRICE QUOTATIONS
All price quotations, written or verbal, are valid for 30 days from the date of quotation.

DESIGN
All of our cakes are handmade individually therefore slight differences in colours, decorations and design can occur. Please note we are cake designers and we can not copy a cake that we haven’t designed. Our cakes are bespoke and unique.

FRESH FLOWERS
We love to work with fresh flowers. In most cases we will ask your florist to provide the flowers. Without a selection of beautiful flowers we can not create a Delicieux masterpiece. Please ensure your florist keeps enough flowers aside for your cake since it’s a centerpiece. These flowers should be fresh, not wilted or damaged and in water ready for us to arrange at the wedding venue. We will advise your florist on the type of flowers suitable for your cake. Please note flowers are classified as non edible.

ALTERATIONS
If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 6 weeks before completion may be subject to a surcharge. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.

DAMAGES
In the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage to us within 48 hours and send photographic evidence of the damage within 3 working days if you wish to claim a refund or replacement. The Seller will not take back any undamaged goods from the Buyer unless agreed in writing by the Seller. The Seller accepts no liability for cakes that are damaged after they have been delivered to the agreed location. For cakes delivered to venues, the Seller requires a signed delivery note by the person in charge to say that the cake has arrived and that it arrived in perfect condition.

Damages after this point are not Delicieux Cakes’ responsibility. All our wedding cakes are fragile and require care and attention when handling, storing, and displaying. Please pay careful attention to our storage and transportation (where relevant) instructions that will be provided with the cake. Where samples of the Goods are shown to the Buyer, the Buyer hereby accepts that they consider such samples to be representative of the Goods. Any description applied to the Goods is only given by way of identification and does not constitute a sale by description. Any image provided as part of the description of similar goods is given for illustrative purposes only. Given the nature of the goods, minor variations of colour and design may apply.

ALLERGIES AND SPECIAL DIETARY REQUIREMENTS
Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, however, our products may not be suitable for those with certain allergies as our kitchen does handle wheat and nuts. All allergens will be noted in writing all our invoices and on the delivery note to the venue/client.

DELIVERY AND COLLECTION
If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once they have left our premises. The collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Buyer. The cake or products can be very fragile so we advise to drive very slowly and carefully and we could provide you with a non slipping mat.

If delivery has been requested, we will deliver the cake on the day set out in the order confirmation to the address provided. We do not offer specific delivery times. Delicieux Cakes will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the Company cannot accept liability for delays and time shall not be of the essence.

If the delivery address changes after the order has been confirmed additional charges may be added to cover extra mileage.

When delivering to a wedding venue, we will contact the venue in advance to arrange a mutually convenient time for delivery. If we set up the wedding cake, we shall take a photograph of the cake before leaving and, where possible, obtain a signature from the venue confirming the cake has been received in good condition. Should the venue need to set up the cake themselves we shall explain how the cake is to be displayed and where possible, obtain a signature to verify we have done so. Once the cake has been delivered, we are unable to accept liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.

AFTER DELIVERY
Goods placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damage to Goods. Please note, we do not provide cake tables, tablecloths or cutting knives. It is the responsibility of the Buyer to provide these or check with the venue to ensure these items are provided. A shelf life and Best Before Date will be provided on the Delivery Note as well as storage suggestions. This is advisory only. Please note, once a cake has been cut into the shelf life will be reduced.

NON-EDIBLE INGREDIENTS AND DECORATIONS
Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving or eating.

Please note fresh flowers are classified as non edible ingredients and should be removed.

COMPLAINTS
Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Any issues must be brought to our attention within 48 hours of collection or delivery to give fair opportunity to assess the nature of the complaint.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested, and no further claims can be made. Wedding cake clients will be sent a detailed sketch of their wedding cake prior to the wedding. It is the client’s responsibility to check that this meets with their requirements and raise any issues with us if there are any discrepancies.

Where the complaint is in regard to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.

Please note we can only deal with the client who placed the original order.
